Politically Motivated Lawsuit Against the Colorado Opportunity Caucus Dismissed as Meritless

DENVER, CO –
Today, Chair of the Colorado Opportunity Caucus Sen. Lindsey Daugherty released the following statement after the unsubstantiated Colorado Open Records Act lawsuit filed against the Opportunity Caucus by a political advocate was dismissed with the court stating the plaintiff “has not shown even minimal evidence" in support of his claim.

“The dismissal of this meritless lawsuit confirms what we have known from the start. This was a frivolous lawsuit intended not to champion transparency but simply an attempt to harm and harass members of the caucus and score cheap political points. Members of the Opportunity Caucus have consistently respected and followed Colorado’s open records laws and have always been responsive to requests based on legal guidance from the Office of Legislative Legal Services. Anyone can file a lawsuit against anyone for any reason in America. That does not signify that there is any legal merit or substance to the accusations, which is what the judge determined. The people of this state are tired of hearing and reading about these political games. The Opportunity Caucus will continue to focus on what actually matters to Coloradans: building a state where each and every Coloradan can afford to live, work, and raise a family.”

The lawsuit was dismissed under Colorado’s Anti-Strategic Litigation Against Public Policy (Anti-SLAPP) statute, a law requiring dismissal of meritless lawsuits that chill the exercise of free speech and petitioning rights.
